අධිකරණ බලය යනු ජනතාව සතු බලයක් බැවින් ජනතාව අධිකරණය සොයා ඒම වෙනුවට අධිකරණ පද්ධතිය ජනතාව වෙත සමීප කරවීම රජයේ මූලික අරමුණ බව අමාත්ය කේ. ඩී. ලාල්කාන්ත මහතා පාර්ලිමේන්තුවේදී ප්රකාශ කළේය. 22 වැනි ආණ්ඩුක්රම ව්යවස්ථා සංශෝධන පනත් කෙටුම්පත පිළිබඳ විවාදයට එක්වෙමින් අමාත්යවරයා සඳහන් කළේ, අධිකරණ පද්ධතිය කඩිනමින් යාවත්කාලීන කිරීම ජනතාවගේ ප්රධානතම අභිලාෂයක් වන අතර මෙම ආණ්ඩුක්රම ව්යවස්ථා සංශෝධනය එහි එක් ආරම්භක පියවරක් පමණක් බවයි. එහිදී වැඩිදුරටත් අදහස් දැක්වූ අමාත්යවරයා මෙසේද පැවසීය. "අපේ අධිකරණ පද්ධතිය දීර්ඝ කාලයකින් යාවත්කාලීන නොවීම නිසා මෙරට සාමාන්ය ජනතාව දැවැන්ත පීඩාවකට පත්ව සිටිනවා. නඩු කටයුතු අනවශ්ය ලෙස කල්ගත වීම නිසා රජයට මෙන්ම මහජනතාවටද විශාල මුදලක් හා කාලයක් නාස්ති කිරීමට සිදුව තිබෙනවා. නඩුවාර 20ක් හෝ 25ක් අධිකරණයට යෑමට සිදුවන සාමාන්ය මිනිසෙකුට නීතිඥ ගාස්තු, ගමනාගමන වියදම් සහ ආහාර පාන සඳහා තමන් උපයන ධනයෙන් අතිවිශාල මුදලක් යට කිරීමට සිදුවන ඛේදනීය තත්ත්වයක් පවතින්නේ. අධිකරණ පද්ධතිය තුළ පවතින මෙම ප්රමාදය සහ ගැටලුකාරී ස්වභාවය නිසා, යම් අපරාධයක් හෝ රිය අනතුරක් දුටුවද ඒ වෙනුවෙන් පොලිසියට ගොස් සාක්ෂි දීමට හෝ නීතිය ඉදිරියට ඒමට සාමාන්ය ජනතාව දැඩි මැළිකමක් දක්වනවා. උසාවි ගානේ රස්තියාදු වීමට සිදුවීමෙන් තමන්ට සිදුවන කරදරය හේතුවෙන් බොහෝ දෙනා නිහඬව සිටීමට පෙළඹීම නිසා යුක්තිය පසිඳලීමේ ක්රියාවලියම මගහැරී යනවා. අධිකරණ බලය යනු පාර්ලිමේන්තුවට හෝ විනිසුරුවරුන්ට අයත් දෙයක් නොව, එය මුළුමනින්ම මහජනතාවගේ පරමාධිපත්ය බලයක්. අද වන විට යාපනයේ සිට හෝ අම්පාරේ සිට ජනතාවට කොළඹ අධිකරණ සොයා පැමිණීමට සිදුව තිබෙනවා. මෙම තත්ත්වය වෙනස් වී අධිකරණය ජනතාව ළඟට ගෙන යා යුතුයි. වගකිවයුතු ප්රගතිශීලී රජයක් ලෙස මෙම දුර්වලතා නිවැරදි කර අධිකරණ පද්ධතියේ කාර්යක්ෂමතාව ඉහළ නැංවීමට අවශ්ය ඉදිරි ප්රතිසංස්කරණ සියල්ල කඩිනමින් සිදුකිරීමට අප පියවර ගන්නවා." Minister Emphasizes Court System's Accessibility to the Public in Parliamentary Debate The Minister of Justice, K.D. Lal Kantha, articulated in Parliament that the judicial authority inherently belongs to the people. He underscored that the fundamental role of the government is to bring the judicial system closer to the populace, rather than having the public seek out the courts. During a debate on the 22nd constitutional amendment bill, he highlighted the pressing need for swift reform in the judicial system, viewing this amendment as merely a starting point in that direction. As he elaborated further, the minister pointed out, "Our judicial system has not been updated for an extended period, subjecting ordinary citizens in this country to significant distress. The unnecessary delays in legal proceedings have resulted in substantial financial and time losses for both the government and the public. Individuals faced with 20 or 25 lawsuits find themselves in a tragic situation, driven to exhaust considerable amounts of their earned income on legal fees, transportation costs, and sustenance." The persistent delays and problematic nature of the judiciary have instilled a serious reluctance among the general public to engage with the legal system, even in cases of crime or traffic accidents, as they hesitate to approach the police and provide evidence. Many individuals remain silent due to fears of the inconveniences associated with appearing in court, ultimately hindering the process of justice. He stressed that judicial power is neither the domain of Parliament nor of judges but is fundamentally the sovereignty of the people. Currently, residents from as far as Jaffna or Ampara are compelled to travel to Colombo to seek justice. This situation needs to change, and it is imperative that the judicial system is brought to the people. As a responsible and progressive government, we are committed to rectifying these inefficiencies and undertaking all necessary reforms to enhance the efficiency of the judicial system without delay. *Note: In case of any discrepancy between the Sinhala and English versions, the Sinhala version shall prevail.
