2023 අංක 9 දරන දූෂණ විරෝධී පනත සංශෝධනය කිරීම සඳහා රජය විසින් ඉදිරිපත් කර ඇති නව කෙටුම්පත මගින් වත්කම් හා බැරකම් ප්‍රකාශ කිරීමේ විනිවිදභාවය සහ ශක්තිමත් යාන්ත්‍රණය දැඩි ලෙස අඩපණ වන බවට දේශීය මෙන්ම ජාත්‍යන්තර සිවිල් සංවිධාන ගණනාවක් දැඩි කනස්සල්ල පළ කර තිබේ. ට්‍රාන්ස්පේරන්සි ඉන්ටර්‍නැෂනල් ශ්‍රී ලංකා ආයතනය, විකල්ප ප්‍රතිපත්ති කේන්ද්‍රය ඇතුළු සිවිල් සංවිධාන 86ක එකමුතුවක් පෙන්වා දෙන්නේ, මෙම යෝජිත සංශෝධන හේතුවෙන් පුරවැසියා සතු තොරතුරු දැනගැනීමේ අයිතියට සහ භාෂණයේ නිදහසට දැඩි බාධා එල්ල වන බවයි. පසුගිය අගෝස්තු 19 වනදා පාර්‍ලිමේන්තුවට ඉදිරිපත් කෙරුණු මෙම පනත් කෙටුම්පත මගින් මුල් පනතේ වගන්ති 18ක් සංශෝධනය කිරීමට යෝජනා කර ඇත. මෙම කෙටුම්පත සම්බන්ධයෙන් රජය සහ ජාත්‍යන්තර මූල්‍ය අරමුදල අතරද මේ වන විට විශේෂ සාකච්ඡා වට කිහිපයක් පැවැත්වෙමින් පවතී. එහිදී යෝජිත ඇතැම් සංශෝධන මගින් වත්කම් හෙළිදරව් කිරීමේ ක්‍රියාවලිය දුර්‍වල විය හැකි බවත්, අධිකරණයේ ස්වාධීනත්වය පිළිබඳ ගැටලු පවා මතු විය හැකි බවත් ජාත්‍යන්තර මූල්‍ය අරමුදල පෙන්වා දී ඇති බව වාර්‍තා වේ. ඒ අනුව, ආන්දෝලනාත්මක ඇතැම් යෝජනා හකුළා ගැනීමට සිදුවනු ඇතැයිද පැවසේ. 2023 අංක 9 දරන මුල් පනත මගින් මහජන නියෝජිතයන් සහ රාජ්‍ය නිලධාරීන්ගේ වත්කම් මහජනතාවට හා මාධ්‍යවේදීන්ට නිරීක්ෂණය කිරීමට පුළුල් ඉඩකඩක් ලබා දී තිබිණි. එහෙත්, නව සංශෝධන කෙටුම්පතේ 11 වැනි වගන්තිය මගින් පුද්ගලිකත්වයට බලපාන "වෙනත් තොරතුරු" සංස්කරණය කර වසන් කිරීමට දූෂණ විමර්‍ශන කොමිසමට අසීමිත බලයක් පවරා ඇත. එලෙස සංස්කරණය කරන ලද වත්කම් ප්‍රකාශයක් නියමිත කාර්‍යයෙන් බැහැරව වෙනත් කරුණකට භාවිත කිරීම වරදක් බවට පත් කරමින්, ඊට එරෙහිව රුපියල් ලක්ෂයක උපරිම දඩයක් සහ වසරක සිරදඬුවමක් නියම කිරීමට යෝජනා කර තිබීම තොරතුරු දැනගැනීමේ අයිතියට එල්ල කළ මරු පහරක් බව සිවිල් සංවිධාන අවධාරණය කරයි. මීට අමතරව, නිලධාරීන් විසින් වත්කම් ප්‍රකාශ කළ යුතු ආයතන නිර්‍ණායකයේදී, රජයේ කොටස් හිමිකාරිත්ව සීමාව සියයට 25 සිට සියයට 50 දක්වා ඉහළ දැමීමටද සංශෝධන මගින් යෝජනා කර තිබේ. එමගින් රජයේ පාලනය පවතින ආයතන රැසක නිලධාරීන් වත්කම් බැරකම් හෙළිදරව් කිරීමේ වගකීමෙන් සම්පූර්‍ණයෙන්ම නිදහස් වන බවටද දැඩි චෝදනා එල්ල වී ඇත. Concerns Arise Over Proposed Amendments to Anti-Corruption Legislation in Sri Lanka Several local and international civil organizations have expressed deep concern regarding a new proposal aimed at amending Sri Lanka’s Anti-Corruption Act No. 9 of 2023. They warn that the modifications would severely undermine asset and liability disclosure requirements, compromising transparency and accountability. A coalition of 86 civil organizations, including Transparency International Sri Lanka and the Centre for Alternative Policy, has highlighted that these proposed amendments could significantly obstruct citizens' right to information and freedom of expression. Introduced to Parliament on August 19, the proposed bills suggest changes to 18 provisions of the original act. Currently, the government is engaged in important discussions with the International Monetary Fund regarding these amendments. Reports indicate that some proposed changes could weaken the asset disclosure process and even raise concerns about judicial independence. There is speculation that contentious proposals may ultimately be withdrawn following these discussions. The original Act of 2023 provided broad access for the public and media to monitor the assets of public representatives and state officials. Conversely, the new amendments include a controversial clause allowing the Commission to Investigate Allegations of Bribery or Corruption (CIABOC) extensive power to modify “other information” affecting privacy. Such modifications would categorize the misappropriation of amended asset declarations for purposes other than outlined duties as an offense, potentially resulting in fines of up to one million rupees and a year's imprisonment. Civil organizations have condemned this as an assault on the right to information. Moreover, the amendments propose increasing the ownership threshold for officials required to disclose their assets from 25% to 50% in government-owned entities. This change has sparked serious allegations that it would exempt numerous officials in government-run institutions from the obligation to disclose their assets. *Note: In case of any discrepancy between the Sinhala and English versions, the Sinhala version shall prevail.
