රජය විසින් ඉදිරිපත් කර ඇති 22 වන ආණ්ඩුක්රම ව්යවස්ථා සංශෝධන පනත් කෙටුම්පත නීතියක් බවට පත් වුවහොත්, එහි ප්රතිලාභ ලබන පළමු ශ්රේෂ්ඨාධිකරණ විනිසුරුවරයා වන්නේ වත්මන් අගවිනිසුරුවරයා බව ශ්රී ලංකා නීතිඥ සංගමය පවසයි. නීතිඥ සංගමය පෙන්වා දෙන්නේ වත්මන් අගවිනිසුරුවරයාගේ ධුර කාලය 2026 දෙසැම්බර් 01 වැනිදා අවසන් වීමට නියමිතව ඇති බවයි. එම ධුර කාලය දීර්ඝ කිරීමේ අරමුණින් මෙම ව්යවස්ථා සංශෝධනය කඩිනමින් ඉදිරියට ගෙන යන බවට සමාජය තුළ පුළුල් මතයක් පවතින බව ද එම සංගමය නිකුත් කළ නිවේදනයක සඳහන් වේ. යෝජිත 22 වන සංශෝධනය මගින් අධිකරණයේ ස්වාධීනත්වයට මෙන්ම ජනතාවගේ මූලික අයිතිවාසිකම්වලට බරපතල බලපෑමක් එල්ල වන බව නීතිඥ සංගමයේ ස්ථාවරය වී ඇත. මේ හේතුවෙන් අදාළ සංශෝධනයේ ව්යවස්ථානුකූලභාවය අභියෝගයට ලක් කරමින් ශ්රී ලංකා නීතිඥ සංගමය දැනටමත් ශ්රේෂ්ඨාධිකරණය හමුවේ පෙත්සමක් ගොනු කර තිබේ. මෑත කාලීනව අගවිනිසුරුවරයා ඇතුළු අධිකරණ පද්ධතිය ඉලක්ක කරගනිමින් පාර්ලිමේන්තුව තුළ සහ සමාජ මාධ්ය ඔස්සේ එල්ල වන විවිධ චෝදනා සහ ප්රහාර පිළිබඳව ද නීතිඥ සංගමය සිය දැඩි අවධානය යොමු කර ඇත. අධිකරණය යනු නීත්යනුකූල විමර්ශනයට සහ වගවීමට යටත් විය යුතු ආයතනයක් වුවද, විනිසුරුවරුන් සම්බන්ධයෙන් එල්ල වන ඕනෑම විශ්වසනීය චෝදනාවක් පවතින ව්යවස්ථාපිත ක්රියාපටිපාටියට අනුකූලව විමර්ශනය කළ යුතු බව එම සංගමය අවධාරණය කරයි. තහවුරු නොකළ කරුණු මත පදනම්ව විනිසුරුවරුන්ට සහ නීතිඥවරුන්ට එල්ල කරන පුද්ගලික ප්රහාර මගින් යුක්තිය පසිඳලීමේ පද්ධතිය කෙරෙහි පවතින මහජන විශ්වාසය බිඳ වැටෙන බවත්, එය සමස්ත නීතියේ ආධිපත්යයට තර්ජනයක් බවත් නීතිඥ සංගමය වැඩිදුරටත් පෙන්වා දෙයි. අධිකරණයේ ස්වාධීනත්වය ආරක්ෂා කිරීම ජනතාව වෙනුවෙන් පවතින ආරක්ෂණයක් බැවින්, අධිකරණ පද්ධතියට ගරු කරන ලෙසත්, පවතින ගැටලු නීත්යනුකූල රාමුව තුළ පමණක් සාකච්ඡා කරන ලෙසත් නීතිඥ සංගමය රජයෙන්, මාධ්යවලින් සහ සියලු පාර්ශ්වයන්ගෙන් ඉල්ලා සිටියි. මෙම නිවේදනය ශ්රී ලංකා නීතිඥ සංගමයේ සභාපති රජීව් අමරසූරිය සහ ලේකම් නලින් ද සිල්වා යන මහත්වරුන්ගේ අත්සනින් යුතුව නිකුත් කර තිබේ. Recent allegations targeting the Chief Justice and the judicial system, surfacing both in Parliament and on social media, have garnered the Bar Association's close attention. While they acknowledge the necessity for lawful scrutiny and accountability regarding judges, the Association stresses that any credible accusations should follow the constitutional process for investigation. Moreover, they assert that unsubstantiated personal attacks on judges and lawyers threaten public confidence in the justice system, posing a serious risk to the overall integrity of the rule of law. In their statement, the Bar Association emphasizes that safeguarding judicial independence is a critical protective measure for the populace. They urge the government, media, and all stakeholders to address existing issues strictly within the legal framework.
